How can a person be preemptively pardoned if they not been convicted of a crime, much less even charged with one….?

How can you “plead the 5th” if you are “pardoned” for said unstated crime?

Question 1. Unknown, Bidens preemptive pardon extravaganza was the first time in history this was done. Likely will need for the pardons to be challenged and take a SCOTUS ruling to see if it is effective or not. If not, I cna forsee every President preemptively pardoning their administration ust before every handover now that Democrats have decided open-season lawfare is the way to go.
Question 2. Taking the fifth wasn’t for the crimes he was or was potentially not pardoned for at the time. It was to prevent his being prosecuted for lying to Congress in this round of testimony as he would most likely have lied in response to the question asked if he had not done so given his prior testimony and statements both before Congress and to the public contradicted his journal entries on the same subjects.
I don’t see how a preemptive pardon can stand. First, those preemptively pardoning are confessing to knowing of a crime, and not reporting the crime. Second, without a criminal complaint, no crime was committed, and a pardon has no merits. Of course, if it works, future Presidents can cover up all types of illegal activities with the stroke of a pen. How Congress, or the DOJ can allow such a thing is beyond comprehension.

Legality doesn’t matter here, prosecution does. He knew going in that by doing this he was going to look like the evil jackass he is, but he would never be prosecuted. The wealth he amassed in his years of public service remains intact also. This is the model for every government criminal of that era. To think otherwise is just wishful thinking. Nothing will every happen to any of them. Moving on is hard, but stewing on it only lets them live rent free in our heads.
